WHAT IS HAPPENING

The U.S. Department of Labor (DOL) announced in August a proposal to substantially expand overtime for salaried workers.  Under the proposed rule, the cutoff for receiving overtime pay after 40 hours a week would rise to about $55,000 a year from its current level of about $35,500.

You can help by submitting a personalized comment to the DOL. We anticipate the National Restaurant Association trying to gut this proposal, so we need to submit as many comments as possible. The comment period ends on November 6, 2023.

I strongly urge the Department of Labor to move forward with this proposed rule. $55,000 a year is necessary increase to ensure salaried employees are treated fairly. New York and California have already established a higher threshold, and we can’t let the rest of the country continue to fall behind. Further, restaurant employers often pay salaried staff slightly above the threshold so that they don’t have to pay them overtime. It’s a problem we need to fix now. We can’t wait any longer for the proposed raise.
